Prosedur Dan Tata Cara Mendapatkan Hak Atas Tanah Melalui Permohonan Hak Atas Tanah Di Bpn Kabupaten Probolinggo
Abstract
In the discussion of writing scientific papers, the focus is on issues regarding procedures and procedures for obtaining land rights through land rights applications that occur at the Probolinggo Regency BPN. In order to ensure legal certainty, procedures for the transfer of land rights according to Law Number 5 of 1960 are required to be registered as one of the registered land rights so as to realize unification and simplicity as well as legal protection in Indonesian land law in accordance with the objectives of the UUPA. Various factors influence public interest in sporadic procedures for transferring land rights. Therefore, the problem is why there are legal obstacles in the implementation of procedures for transferring land rights sporadically for the community and how to overcome these obstacles in implementing the transfer of land rights. This research is a type of empirical research using a sociological juridical approach, research location, data collection tools, namely interviews and literature study. The analysis technique used is descriptive analysis technique. From the results of the research using the above method, the author obtained answers to existing problems, namely the obstacles in implementing land registration, namely the government policy factor regarding tax obligations in the transfer of land rights, the factor of not understanding the function and use of certificates, the assumption that it requires expensive fees, the factor the assumption that it takes a long time to process the certificate, the assumption that the transfer of rights to the land owned is very strong. Efforts made by the Land Office to overcome these obstacles are by carrying out outreach and outreach aimed at increasing public awareness regarding the importance of land registration and implementing PRONA to improve people's welfare.
