Kedudukan Status Tanah Hak Milik Terindikasi Musnah Setelah Terdampak Erupsi Gunung Semeru

Salah satu bencana alam berupa Erupsi Gunung Semeru yang terjadi pada tanggal 4 Desember 2021 di Kabupaten Lumajang lalu menyebabkan banyak kerugian yang dirasakan oleh masyarakat Dusun Curah Kobokan dikarenakan tanah miliknya tertimbun pasir bahkan terindikasi musnah, oleh karena itu hak atas tanahnya menjadi tidak jelas. Tujuan penelitian ini adalah untuk memberikan pemahaman kepada masyarakat bahwa musnahnya tanah berstatus hak milik akibat bencana alam pengaturannya ditemukan dalam UU Nomor 5 Tahun 1960 tentang Peaturan Dasar Pokok Agraria, UU Nomor 24 Tahun 2007 perihal Penanggulangan Bencana, serta PMA-ATR/Ka. BPN Republik Indonesia Nomor 17 Tahun 2021 Tentang Tata Cara Penetapan Tanah Musnah. Metode penelitiannya menggunakan tipe penelitian yuridis normatif yang menekankan pada kajian peraturan perundang-undangan, serta penulisannya menggunakan pendekatan kualitatif, berdasarkan sumber bahan hukum primer dan sekunder, kemudian ditelaah dan dikaji secara seksama. Hasilnya diketahui bahwa tanah hak milik yang terdampak erupsi gunung semeru hingga terrindikasi musnah oleh Pemerintah Daerah Kabupaten Lumajang disikapi secara yuridis dengan pengaturan perubahan status tanah berdasarkan peraturan perundang-undangan yang berlaku seingga tidak merugikan masyarakat yang berhak atas tanah dimaksud, serta penyikapan secara sosial melalui pemberian fasilitasiHunian Sementara (Huntara) di Desa Sumbermujur, setelah terpenuhi syarat-syaratnya. Selanjutnya dalam hal terbukti tanahnya musnah maka masyarakat pemegang hak atas tanah milik yang bersangkutan akan diberikan fasilitas Hunian Tetap (Huntap), walaupun saat ini legal formal hak pemanfaatannya masih belum bersifat tetap.

Humans and the land in their environment have an inseparable relationship, from the time humans are born until they die, the relationship between humans and the land arises from the philosophy of each people of a nation, regarding the land on which they live. The biggest myth that people believe about land comes from the existence of two natural phenomena. The two phenomena are the sky as the father of the universe and the earth as the mother. It is this marriage of heaven and earth that produces everything that exists on earth, including humans as their children. The enactment of the Basic Agrarian Law (Law Number 5 of 1960) in Indonesia since September 24 1960 means that all matters relating to land are regulated by this Law and its implementing regulations. Article 26 of the Basic Agrarian Law regulates issues relating to buying and selling land and is also regulated by implementing regulations in Article 19 of Government Regulation Number 10 of 1961 in conjunction with Article 37 of Government Regulation Number 24 of 1997 concerning Land Registration. There are so many problems regarding the sale and purchase of land that result in prolonged conflicts. Disputes occur because the parties do not pay attention to the legal aspects of a land sale and purchase agreement, or it could also be that the sale and purchase agreement fulfills the material requirements but does not change names. Things like this result in a lack of guarantee of legal certainty for the land buyer.

Berdasarkan perkembangan kebutuhan manusia yang semakin bertambah, begitu pula pada jaringan informasi dan komunikasi. Akan tetapi perkembangan IPTEK tersebut tidak hanya membawa efek positif saja, melainkan membawa efek negatif. Ketika perkembangan negatif mulai bermunculan. Perkembangan negatif tersebut dapat dilihat dari munculnya sebuah tindak pidana baru (cybercrime) yakni berupa prostitusi yang dapat dilakukan secara online, yakni kegiatan prostitusi yang dapat dilakukan hanya dengan mengakses jaringan internet atau komunikasi tertentu. Berdasarkan uraian latar belakang yang telah dipaparkan di atas, maka merasa perlu dilakukan sebuah pembahasan yang membahas mengenai cara pengaturan serta penanggulangan kejahatan Prostitusi secara online dalam cyberspace yang telah meresahkan banyak kalangan beserta sanksi-sanksi yang telah ditetapkan oleh Kitab Undang Undang Hukum Pidana (KUHP) , Undang Undang (UU) No 11 Tahun 2008 tentang Informasi dan Teransaksi Elektronik serta Undang Undang (UU) No. 44 Tahun 2008 tentang Pornografi secara lebih mendalam.

There are many problems experienced by Indonesian migrant workers, both regarding salaries and other problems. The problem of Indonesian Migrant Workers is actually a complex problem, because in almost every stage starting from recruitment, pre-placement period, placement period, to post-placement, Indonesian Migrant Workers are very prone to problems.The aim of this research is to produce a discussion regarding the Forms of Social Security Legal Protection for Indonesian Migrant Workers and Social Security Legal Protection for the families of Indonesian Migrant Workers. The research method used is normative juridical research with a statutory approach and a conceptual approach towards primary legal materials (in the form of relevant statutory regulations).The rights of migrant workers in social protection are guaranteed by law, Legal Protection of Indonesian Migrant Workers based on Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, articles 7 to article 24, divided into three stages, namely the pre-placement period, during placement and after placement. The families of Indonesian migrant workers also receive legal protection regarding their rights to obtain information, education and training costs in accordance with the provisions of applicable laws and regulations.

This study aims to determine the effectiveness of the application of the e-ticket system in the Probolinggo City Police area and the obstacles in its application. The writing method in this research is the empirical research method. Empirical legal research or observational research which is another approach model in researching law as its research object, this type of legal research is carried out by analyzing and studying a problem directly, whether it is done by interview or by making an observation. The results of the study show that E-tickets have been implemented in monitoring traffic violations such as violations of e-tickets for fake motorized vehicle license plates which are studied from the aspects of facilities and infrastructure, community aspects and cultural aspects. Providing existing solutions in carrying out police duties so as to make them relatively compatible with the application of E-tickets as a new mechanism for enforcing road traffic law in Indonesia.

Terminal for Own Interest (TUKS) is a terminal located within the Work Environment Area (DLKr) and the Interest Environment Area (DLKp) of a port which is part of the port to serve its own interests in accordance with its main business. PT. Kutai Timber Indonesia (KTI) is engaged in the marketing of timber and manufacture of plywood and wood-based products located in Indonesia. With activities in the Primary Industry of Timber Forest Products PT. Kutai Timber Indonesia (KTI) has used the marine environment of the Terminal for its Own Interests within the Work Environment Area and the Interest Environment Area of Probolinggo Port to support its activities. With that, PT. Kutai Timber Indonesia entered into a Cooperation Agreement on the Use of Waters with the Class IV Probolinggo Port Authority and Port Authority Office which is a Technical Implementation Unit within the Ministry of Transportation which is under and responsible to the Director General of Sea Transportation.

Gambling games have been known and played for a long time, namely when Indonesia still consisted of kingdoms around the fifth century AD. At that time the most popular gambling games were animal fights such as cockfights, sheep, horse races, cow races and other animal complaints. Along with the times, gambling games have also experienced quite significant developments in terms of their types. So that more modern types of gambling emerged such as lottery games, cards, dexterity using machine media such as pinball, jackpots, slots, and others. In this modern era, gambling games can be played online, where online gambling is carried out using technology that can be accessed via the internet.
Law enforcement is carried out by law enforcers, law enforcement in society also depends on public awareness. Law enforcement by the Probolinggo City Police was carried out against perpetrators of online gambling crimes which were carried out under the provisions of Law No. 19 of 2016 on amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions. While carrying out their duties, the Probolingoo City Police have made several efforts, namely penal efforts, non-penal efforts / countermeasures (Repressive), and preventive efforts (Preventive).
There are several obstacles in the increase of perpetrators of online gambling crimes at the Probolinggo City Police, including: Lack of human resources (HR) and mastery of information technology by investigators in uncovering perpetrators of online gambling crimes, lack of cooperation with related agencies to obtain information on online gambling crimes, lack of public trust to cooperate with the Probolinggo City Police

In protecting interested parties, it is considered necessary to realize legal certainty for land rights and to maintain national security and stability in general as well as development in particular. Research entitled "Implementation of Complete Systematic Land Registration (PTSL) Based on the Regulation of the Minister of Agrarian and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 6 of 2018 concerning Complete Systematic Land Registration (PTSL)"have a formulation of the problem of how the mechanism for implementing the Complete Systematic Land Registration (PTSL) in accordance with the Regulation of the Minister of Agrarian and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 6 of 2018 in the Probolinggo City Land Office Area and what are the inhibiting factors in the implementation of the Complete Systematic Land Registration (PTSL) at the Probolinggo City Land Office and what efforts are made by the Land Office Probolinggo City in overcoming obstacles in the implementation of the Complete Systematic Land Registration (PTSL).

The approach method used is empirical juridical by using data on primary and secondary legal materials. The required data can be obtained from the explanation of authorized persons at the Probolinggo City Land Office, library books, magazines, and the internet.

Based on the data analysis conducted, it was concluded that the mechanism of Complete Systematic Land Registration (PTSL) at the Probolinggo City Land Office includes: determination of location, subjects and objects of land rights, establishment of a Complete Systematic Land Registration organizational structure, counseling and juridical data collection. There are several obstacles from the village and the community who are participants, both in terms of technical (field activities) and juridical aspects (administrative records). Efforts to overcome problems with the timely implementation of measurement activity schedules between measuring officers, as well as improving services for timely completion of Complete Systematic Land Registration certificates.

This study aims to determine the distribution of inheritance from adoptive parents to their adopted children, especially those regulated according to customary law. while this research was conducted in Gending District, Probolinggo Regency.
Based on my opinion, Customary Inheritance Law regulates the process of forwarding and transferring assets, both tangible and intangible, from the heir while he is still alive and/or after he dies to his heirs.In the context of development and modernization, on the other hand, if there is a tendency to abolish customary law altogether, the work will be in vain, because customary law has been institutionalized firmly, unless the ethics of customary law has animates society and continues to develop, customary law in relation to source for materials in the formation of national laws. In accordance with the nature of nature that in this life we as humans at certain times need a sense of mutual need as God's fellow creatures, and with that we are met in a marriage, with the existence of a marriage,Children are a mandate given by Allah S.W.T to husband and wife to be cared for and educated so that these children can live independently and bring happiness to their parents, children are also expected to be able to protect the interests and care for their mother and father in old age, therefore the meaning of children importance in a family and society, still consider the absence of children in the family and happiness is not complete.
