Abstract

As an illustration and phenomenon at the level of resolving traffic accidents, the National Police as an investigation into the accident, whether it resulted in the death of the victim, or experiencing physical disability, has attempted to use mediation in resolving accident cases. This study aims to analyze traffic accident cases that were resolved with the Disposti Resolution justice approach and whether the investigators considered using a restorative justice approach to resolve traffic accident cases. This type of research is normative law. From the research conducted, it is known that in resolving cases of traffic violations that occurred at the Samarinda Police, the best way is to apply the Disposti Resolution justice (restorative justice) settlement, which is to bring together the perpetrator-victim, and the family to resolve the dispute in the presence of witnesses. Local police. And Investigators consider the need for a Disposti Resolution justice approach in traffic accident cases based on mutual respect between the victims and perpetrators so that there will be no buildup/disputes that occur in the future.
