Analisis Yuridis Tanggung Jawab Notaris Dalam Membuat Dan Menyimpan Minuta Akta Menurut Undang Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris

Abstract

This research aims to determine and analyze the implementation of notaries' responsibilities and obligations in making and storing minutes of deeds in accordance with notarial protocols and to determine the legal consequences for notaries who are negligent in storing minutes of deeds. In compiling this thesis, the author used the method of searching, digging, collecting data or sources of knowledge that currently exist. Then the data is analyzed using qualitative descriptive techniques, namely analyzing it by describing it broadly, completely and sequentially, then presenting it in a logical and systematic form. The results of normative juridical research are discussed by the author to answer all problem formulations. Then conclusions are drawn inductively, namely from general matters to specific matters regarding the problem being researched. From the results of this research, the author concludes that first, the Notary is responsible for making and storing minutes of the deed with the aim of maintaining the authenticity of a deed in its original form, so that if there is forgery or misuse of the grosse, copy or quotation, it can be immediately identified easily by matching it with the original. Second, when storing deed minutes by a notary, the procedures for storing them are not explained in the provisions of the Law on the Position of Notaries. If the Notary violates the provisions of the Notary Position Law, the Notary will be subject to civil sanctions and administrative sanctions based on the Notary Position Law.
